Terms of Service

Article 1 (Purpose)

SimNabuleo AI is a service owned and operated by simcreatio (심크리티오). These Terms of Service set forth the conditions and procedures for the use of the Service, as well as the rights, obligations, and responsibilities between the Operator and Users.

Article 2 (Definitions)

The terms used in these Terms of Service are defined as follows.

• "Service" refers to the SimNabuleo AI website and all AI-generated content provided through it.
• "Operator" refers to the entity operating the Service (simcreatio / 심크리티오).
• "User" refers to any person who accesses the Service and views its content.
• "AI-Generated Content" refers to text content such as analyses, perspectives, and reports automatically generated by artificial intelligence technology.

Article 3 (Effectiveness and Amendment of Terms)

1. These Terms of Service become effective upon posting on the Service website.
2. The Operator may amend these Terms and shall notify Users within the Service at least seven (7) days prior to the effective date of such amendments.
3. For amendments that are disadvantageous to Users, notice shall be given at least thirty (30) days in advance.
4. Continued use of the Service after the effective date of amended Terms shall be deemed as acceptance of the amended Terms.

Article 4 (Provision of Service)

• Service Content: The Service provides AI analytical content across various fields including economy, culture, and technology.
• Access: The Service is available free of charge through the website without separate registration.
• Supported Languages: Korean and English
• Availability: The Service is available 24 hours a day, year-round, except in cases of system maintenance or other exceptional circumstances.

Article 5 (Disclosure Regarding AI-Generated Content)

1. All content on this Service is automatically generated by artificial intelligence (AI). This disclosure is made in compliance with Article 31 of the Korean Artificial Intelligence Basic Act (Act on the Development of Artificial Intelligence and Establishment of Trust) and Article 50 of the EU AI Act.
2. AI-generated content does not guarantee the accuracy, completeness, or timeliness of information.
3. AI-generated content may contain factual errors, biases, or incomplete information.
4. This content does not constitute professional advice, including but not limited to investment, legal, medical, or tax advice.
5. Economic analysis content shall not be used as a basis for investment decisions. Users must consult qualified professionals before making any investment decisions.
6. Users are responsible for independently verifying the information contained in the content.

Article 6 (Modification and Suspension of Service)

1. The Operator may modify or suspend the Service as operationally necessary.
2. Prior notice shall be given in the event of Service modification or suspension.
3. In unavoidable circumstances such as natural disasters or system failures, the Service may be suspended without prior notice, with notice provided thereafter.
4. The Operator may modify or discontinue all or part of the free Service in accordance with its operational policies.

Article 7 (User Obligations and Prohibited Activities)

Users shall not engage in any of the following activities.

1. Interfering with the normal operation of the Service
2. Unauthorized collection of content through automated means (bots, crawlers, scrapers, etc.)
3. Falsely representing content as one's own work
4. Redistributing AI-generated content as professional advice (such as investment advice)
5. Developing competing services using the Service
6. Exploiting security vulnerabilities of the Service or obstructing other Users' access
7. Any activity that violates applicable laws and regulations

Article 8 (Intellectual Property Rights)

1. Intellectual property rights in the Service's design, software code, trademarks, and logos belong to the Operator.
2. The scope of copyright protection for AI-generated content may be limited under applicable laws.
3. Users may view content for personal, non-commercial reference purposes.
4. Commercial reproduction, distribution, or modification of content is prohibited without the prior written consent of the Operator.

Article 9 (Disclaimer)

1. The Service is provided "AS IS" without any express or implied warranties.
2. The Operator makes no warranties regarding the accuracy, completeness, reliability, or timeliness of AI-generated content.
3. The Operator shall not be liable for decisions made by Users based on the content or the consequences thereof.
4. The Operator shall not be liable for any losses resulting from investment decisions based on AI analysis.
5. The Operator shall not be liable for Service interruptions caused by force majeure events including natural disasters, war, terrorism, hacking, or system failures.
6. Notwithstanding the foregoing, pursuant to Article 7 of the Act on the Regulation of Terms and Conditions, liability for damages caused by the Operator's willful misconduct or gross negligence shall not be excluded.

Article 10 (Damages and Limitation of Liability)

1. The Operator shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of the free Service.
2. The Operator's total liability arising from the use of the Service shall be limited to the minimum extent permitted by applicable law.
3. In certain jurisdictions, limitations of liability may not apply, and the mandatory provisions of such jurisdictions shall take precedence.

Article 11 (Governing Law and Dispute Resolution)

1. These Terms shall be governed by and construed in accordance with the laws of the Republic of Korea.
2. Any disputes arising from the use of the Service shall be subject to the exclusive jurisdiction of the Seoul Central District Court as the court of first instance.
3. For Users residing in the EU, this shall not affect mandatory consumer protection rights afforded by the laws of their respective jurisdictions.

Article 12 (Third-Party Advertising)

This Service may display third-party advertisements provided by advertising networks, including Google AdSense. Users acknowledge and agree to the following regarding third-party advertising.

1. The Service utilizes Google AdSense, a third-party advertising service provided by Google LLC, to display advertisements. Google and its advertising partners may place cookies and use tracking technologies on Users' browsers to serve personalized advertisements.

3. The Operator does not endorse and is not responsible for the content, products, or services advertised through third-party advertisements. Any interaction with advertisements is at the User's own risk and subject to the terms and policies of the respective advertisers.

5. The Service shall not artificially encourage Users to click on advertisements or engage with advertisements through deceptive means.

Article 13 (Protection of Children)

The Service does not knowingly collect personal information from or market to children under the age of 13 (or under the age of 14 under Korean law).

1. The Service is not directed at children under the age of 13 (or 14 under Korean law).
2. If the Operator becomes aware that personal information has been collected from a child under 13 (or 14), such information will be deleted without delay.
